Wirral Borough Council (WBC) and the York LGO
In December 2007, Anne Seex delivered her report into my complaint's about Wirral Borough Council (WBC) and in particular a certain Officer, after more than four investigations in all taking several years, and the final investigation taking more than a year which included a home visit by one of her investigators.
All seemed to be going well, I had passed on to the LGO masses of evidence supporting my complaint's, some of which pointed to criminal behaviour by the Director of the Council's Technical Services Department.
All was going well until Mrs Seex's final Report arrived that is, Not only had Mrs Seex mixed up the various elements of a complicated complaint, she had actually rewritten my complaint's to suit herself, thereby ensuring she didn't have to answer my particular complaint's, she omitted some and made other's up.
However even doing that she still got herself in to a jam, and had to rewrite English Law and Public Law in order to exonerate the Council.
Mrs Seex's Report in to my complaint's , must be one of the most obviously unlawful and blatantly illegal finding's passed down by any LGO Office ever..
Mrs Seex even went one step further in ensuring I was unable to obtain justice, by informing the Council that she regarded my 'Freedom of Information' requests to the Council in trying to obtain relevant documents supporting the Council's claims of 'policy' as, ' Vexatious', and therefore the Council did not have to respond to them under the FoI charter, however Mrs Seex quoted from these Documents herself in her Report in to my complaints, which she said she had seen and was satisfied with them.
Which is interesting in itself, as the Council had used these alleged ' Council Policy Documents' against me but had failed to provide me with copies, after over two years of my asking to see them, the LGO then also failed to provide me with them when I asked to see their copies under the FoI Act.
Perhaps most telling of all was that Merseyside Police said that one intepercular Document did not exist after both WBC and Mrs Seex told me the Police had a copy.
The qualifying resident and disabled person mentioned below was my severely disabled mother who at the time that all this started was 76 - she died last August aged 84, she had had a stroke and suffered from sever osteoporosis for the last 12 years of her life.
So what did Mrs Seex's Report contain that was so astonishing at variance with the Law and Public Law, well here is a summery of her Report into my complaints.
Below are just some of her points, there are many many more............
Mrs Seex Ruled, that :-
- 1) Wirral Borough Council is entitled to change their criteria for Resident's Parking Permits in order to deny a qualifying Resident their Permit, even though the new 'Criteria' they used where never passed by the Council, and have never been applied to anyone else since.
- 2) Wirral Borough Council was entitled to allow at first the Police and then WBC itself to issue countless PCN's that they then took to Court and sent Bailiffs to collect the thousands of pounds they amounted to, knowing that they where issued illegally as the Resident was entitled to a Residents Permit.
- 3) Wirral Borough Council can remove a Disabled Parking Bay citing a Rule Change that at the time had not been passed by the Council, and use the rule change to remove just one bay from the same individual that they refused to issue with a Parking Permit.
- 4) Wirral Borough Council was also entitled to implement the proposed Parking Bay Rule Change, retrospectively against my mother even though the rule change had not come in to effect, in order to remove my mothers disabled bay, even though no retrospective action was taken against anyone else in the Borough and still hasn't been five years later.
- 5) It is Okay for a Council Officer to lie to an MP, which the Officer involved did on at least three occasions, Why Angela Eagle MP took no action when she found out a Council Officer had lied to her on several occasions is anyone's guess, except she once admitted in her surgery that, 'We Don't Do Freemasons'.
- 6) The Council Officer issuing Residents Parking Permits to people who do not live within the Residents Parking Scheme Area, 'Is nothing to do with me' as he has discretionary powers, even thought the issuing of such Parking Permits allows these people to avoid a Statutory Parking Fine, which is illegal.
- 7) It was perfectly legitimate for the Council Officer to allow a person to misuse a Visitors Permit for months while they were working and not visiting, even though said Officer was the only person able to investigate and stop it.
- 8) It was also perfectly legitimate for said Council Officer to introduce a special Residents Parking Scheme for one individual resident only, which allowed him to park as many cars as he liked even though he didn't meet the Residents Parking Permit Criteria of having the vehicles registered at his address, which resulted in this guy parking four or more vehicles a day in Residents spaces, which the Police put a stop to, and the Police have said he wasn't even a Resident.
- 9) Mrs Seex said that the Council Officer in charge of all of this has complete discretion in all things to do with PCN's and residents parking.
There is a lot more than even this, but I think you get an idea, I can back all of this up with the relevant letter's from the LGO and Council. Mrs Seex and the LGO may have shredded all of their documents to do with my complaints after six months, but I sure as hell haven't.
